Terms and Conditions

1. Definitions

1.1 “Company” refers to Home Space Studio providing real estate photography and floor planning services.

1.2 “Client” refers to the individual or business entity requesting photography and/or floor planning services.

1.3 “Services” refers to the photography, editing, floor plans, and any additional services agreed upon between the Company and the Client.

1.4 “Deliverables” refers to the final photographic and/or floor plan content provided to the Client.

2. Acceptance of Terms

2.1 By booking our services, the Client agrees to be bound by these terms and conditions.

3. Services

3.1 The Company will provide real estate photography and/or floor planning services as described in the agreed quotation or contract.

3.2 Any changes to the agreed services must be requested in writing and may result in additional charges.

3.3 Floor plans provided are drawn to the best of our ability, with as much accuracy as we can provide, using RICS IPMS (International Property Measuring Standards). However, these plans are to be used for marketing and illustration purposes only. Should the client or their third parties use the plans produced for anything other than marketing and illustration purposes the Company accepts no liability that may arise from said use.

4. Booking and Payment

4.1 The prices for the Deliverables shall be the prices stated in the Company’s price list as supplied to the individual Client or as agreed in writing at the time when the Contract is made. The Company reserves the right to vary its prices from time to time without notice.

4.2 The Company shall be entitled to invoice the Client by email or post for the price of the Deliverables on submission to the Client of the final job listed in the Instructions. The Client shall pay the Company the price of the Content within 30 days of the date of the invoice.

4.3 Payment can be made via bank transfer.

4.4 If the Client fails to make payment of the Company’s invoice, the Company reserves the right to charge interest at 10% above the Bank of England base rate, from the date of the scheduled shoot/appointment, until the balance is paid in full.

4.5 In the event of failed payment all outstanding deliverables will be withheld until the balance has been paid in full.

4.6 In the event of failed payment the Company reserves the right to recover on a full indemnity basis and on demand any costs, expenses (including all legal expenses, court costs and fees and other professional expenses calculated on a full indemnity basis), losses, damages, interest suffered and/or incurred by it as a result of or in connection with the Client’s failure to make payment when due.

5. Cancellation and Rescheduling

5.1 The Company will accept cancellations up to midday on the working day prior to the scheduled appointment without charge unless otherwise stated. Where cancellations are received after midday on the working day prior to the scheduled appointment, the Company shall be entitled to charge the client a late cancellation charge of 50% of the original appointment charge.

5.4 If a Client is running late, a reasonable amount of time – up to 20 minutes after the start of the scheduled appointment time – will be allowed for the Client or their representative to arrive. After this time the appointment will be considered cancelled.

5.5 Rescheduling requests must be made up to midday on the working day prior to the scheduled appointment. The Company will accommodate the request where possible but cannot guarantee availability. Rescheduling requests made after midday on the working day prior to the scheduled appointment will result in a charge of 50% of the original appointment charge.

6. Client Responsibilities

6.1 The Client must ensure that the property is clean, tidy, and ready for photography at the scheduled time.

6.2 The Client is responsible for arranging access to the property and obtaining any necessary permissions.

6.3 The Client is responsible for the accuracy of any information provided to the Company regarding the property.

7. Copyright and Usage Rights

7.1 All images and videos produced by the Company remain the property of the Company until full payment has been received.

7.2 Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the images for marketing and advertising purposes related to the property.

7.3 The Client may not sell, license, or distribute the images to third parties without prior written consent from the Company.

7.4 The Company reserves the right to use the images for promotional purposes, including portfolio display, website, and social media, unless otherwise agreed in writing.

8. Delivery

8.1 The Company will deliver the final images and/or floor plans within 2 working days from the date of the shoot.

8.2 Delivery will be made via download link and/or email where necessary.

8.3 The Company is not responsible for delays caused by unforeseen circumstances or events outside its control.

9. Revisions

9.1 The Client is entitled to 1 round of revisions, if necessary, which must be requested within 5 working days of receiving the deliverables.

9.2 Additional revisions will incur extra charges.

10. Limitation of Liability

10.1 The Company is not liable for any indirect, incidental, or consequential damages resulting from the use of the images.

10.2 The Company’s total liability under these terms shall not exceed the total fee paid by the Client.

11. Complaints

11.1 Any complaints must be made in writing within 7 days of receiving the deliverables. The Company will work to resolve the issue in a timely manner.

12. Force Majeure

12.1 The Company is not liable for failure to perform its obligations due to events beyond its control, including but not limited to natural disasters, strikes, riots, or technical failures.

13. Governing Law

13.1 These terms and conditions are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Miscellaneous

14.1 These terms and conditions constitute the entire agreement between the Company and the Client.

14.2 Any amendments to these terms must be made in writing and signed by both parties.
